Festiivize’s Terms and Conditions

 Introduction

Welcome to Festiivize! These Terms of Service (“Terms”) govern your use of the Festiivize website and platform (collectively, the “Platform”), provided by Festiivize LLC (“Festiivize,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you may not use the Platform.

1.   Key Terms

Freelancers: Users who offer services through the Platform.

Employers/Event Organizers: Users who seek services from Freelancers through the Platform.

Gigs: Services offered by Freelancers on the Platform.

Gig Extras: Additional services offered by Freelancers on top of their Gigs.

Pro Freelancers: Pre-vetted professionals offering services on the Platform.

Orders: Formal agreements between Employers and Freelancers for services.

Cancellation: The process of terminating an Order.

Dispute Resolution: Mechanism for resolving conflicts between parties.

Gig Subscription: Fixed-term subscription for recurring services.

Stock Media: Licensed media available for use in Gigs.

Community Standards: Rules governing user behavior on the Platform.

 

2.   Overview of Main Terms 

Registration: Only registered users may access and use the Platform. Registration is free, and users must provide accurate information.

Gigs and Orders: Freelancers create Gigs detailing their services, terms, and pricing. Event Organizers purchase services through Orders on the Platform.

Payment and Fees: Orders are paid through the Platform, and Festiivize retains a 2% for Freelancers and a 3% charge for Event Host.

Escrow: Payments made on Festiivize are securely held in escrow until the successful completion of the order. This ensures that funds are safely held until the agreed-upon conditions are met, enhancing trust and security for both buyers and freelancers.

–          Release upon Completion: Upon successful completion of the order, funds held in escrow will be released to the freelancer, providing assurance that payment is made only when the agreed-upon services have been delivered satisfactorily.

Delivery and Completion: Freelancers must fulfill orders and deliver services as described in their Gigs. Buyers receive all rights to the delivered work, unless otherwise specified.

Feedback and Ratings: Buyers can provide feedback and ratings based on their experience with freelancers. High ratings enable freelancers to achieve higher levels and access additional benefits.

Community Guidelines: Festiivize users must adhere to community guidelines promoting respect, professionalism, integrity, and compliance with laws and regulations.

Cancellation and Disputes: Orders may be canceled within a specified timeframe, and disputes are encouraged to be resolved between parties first.

 

3.   Freelancers

Freelancers on Festiivize are talented individuals or businesses offering a wide range of event-related services. They possess diverse skill sets and expertise in areas such as event planning, catering, photography, entertainment, decoration, and more. Freelancers are dedicated professionals committed to delivering high-quality services and exceeding the expectations of event organizers.

 

 

 

Gigs:

Gigs on Festiivize represent the services offered by freelancers. Each gig is a unique offering tailored to meet the specific needs and preferences of event organizers. Freelancers create detailed descriptions of their services, including pricing, deliverables, and any additional options or packages available. Gigs may range from full event planning and coordination to specialized services such as DJing, floral arrangements, or technical support.

 

Gig Extras:

Gig Extras are additional services offered by freelancers on Festiivize, allowing event organizers to customize and enhance their experience. These extras provide event organizers with the flexibility to tailor services to their specific requirements and preferences. Freelancers may offer gig extras such as expedited delivery, additional revisions, extended support, premium add-ons, or specialized customization options. By adding gig extras to their orders, event organizers can further optimize their event planning process and ensure every detail is taken care of to their satisfaction.

Pro Freelancers are elite professionals hand-selected by Festiivize for their exceptional skill, experience, and reputation in the event industry. These top-tier freelancers have demonstrated mastery in their respective fields and consistently deliver outstanding results to event organizers. Pro Freelancers undergo a rigorous vetting process to ensure they meet Festiivize’s high standards of quality and professionalism. By working with Pro Freelancers, event organizers can access top-notch expertise and receive unparalleled service for their events.

 

Freelancer Features:

Festiivize offers freelancers a variety of features and tools to enhance their capabilities and streamline their workflow. These features empower freelancers to showcase their skills, manage their gigs effectively, and deliver exceptional service to event organizers/Employers. Some key freelancer features on Festiivize include:

 

Custom Offers: Freelancers can create custom offers tailored to meet the specific needs of event organizers, allowing for flexible pricing and service options.

Project Milestones: Freelancers can set up project milestones for larger gigs, enabling incremental delivery and payment processing to ensure smooth progress and timely completion.

Gig Packages: Freelancers can offer gig packages with different service tiers and pricing options, providing event organizers with greater choice and flexibility when selecting services.

Stock Media Integration: Freelancers can incorporate stock media such as images, videos, or music into their gigs to enhance the quality and appeal of their offerings.

Pro Freelancer Status: Freelancers can aspire to achieve Pro Freelancer status by demonstrating excellence in their work and meeting Festiivize’s criteria for professionalism and quality. Pro Freelancers enjoy enhanced visibility, credibility, and opportunities for growth on the platform.

 

 

4.   Event Organizers (Employers):

Event organizers, also referred to as employers, are individuals or organizations responsible for planning, coordinating, and executing various types of events, ranging from weddings and parties to conferences and corporate gatherings. On Festiivize, event organizers have access to a diverse pool of freelancers offering a wide range of services to support their event planning needs. Whether they’re seeking vendors for catering, entertainment, décor, or logistical support, event organizers (employers) can find talented professionals with the expertise and experience to bring their vision to life. Festiivize provides event organizers (employers) with a user-friendly platform to discover, connect with, and hire freelancers, streamlining the event planning process and ensuring successful outcomes for their events.

 

Purchasing:

Event organizers (employers) can browse through the available gigs and services on Festiivize to find offerings that meet their specific requirements and preferences. Once they’ve identified suitable freelancers and services, event organizers (employers) can initiate the purchasing process by placing an order for the desired gig or service. Festiivize facilitates secure and convenient transactions, allowing event organizers (employers) to make payments directly through the platform using various payment methods. Event organizers (employers) can review gig details, pricing options, and delivery timelines before confirming their orders, ensuring transparency and clarity throughout the purchasing process.

 

5.   Orders:

Upon placing an order for a gig or service, event organizers (employers) enter into a formal agreement with the selected freelancer to deliver the specified services according to the terms and conditions outlined in the gig listing. Festiivize provides a dedicated order page where event organizers (employers) and freelancers can communicate, collaborate, and track the progress of their orders. Event organizers (employers) can monitor order status, provide additional instructions or feedback, and request revisions as needed to ensure their satisfaction with the delivered services. Festiivize maintains a record of all orders and transactions for reference and accountability purposes, facilitating a seamless and transparent experience for event organizers (employers) and freelancers alike.

 

Handling Orders:

Festiivize employs a structured process for handling orders to ensure smooth and efficient service delivery. Upon receiving an order from an event organizer (employer), freelancers are responsible for fulfilling their obligations according to the agreed-upon terms and specifications. Freelancers are expected to communicate promptly with event organizers (employers), adhere to deadlines, and deliver high-quality work that meets or exceeds the event organizer’s (employer’s) expectations. Festiivize provides tools and resources to facilitate order management, including messaging features, milestone tracking, and dispute resolution mechanisms to address any issues or concerns that may arise during the order fulfillment process. By fostering clear communication, mutual respect, and accountability, Festiivize aims to create a positive and productive environment for event organizers (employers) and freelancers to collaborate effectively and achieve successful outcomes for their events.

 

 

 

Reviews

At Festiivize, we believe in transparency and accountability in every transaction. To foster trust and confidence between Event Organizers (Employers) and Freelancers, we provide a review system that allows users to share feedback based on their experiences.

 

How Reviews Work:

Feedback: After completing an Order, both Event Organizers and Freelancers have the opportunity to leave feedback for each other. This feedback consists of a rating and optional comments.

Rating System: Users can rate their experience on a scale of 1 to 5 stars, with 5 being the highest rating. This rating reflects the overall satisfaction with the service provided or received.

Optional Comments: In addition to the rating, users can provide optional comments to further elaborate on their experience. These comments may include specific details about the service quality, communication, timeliness, and overall satisfaction.

 

Purpose of Reviews:

Transparency: Reviews provide transparency by allowing users to share their experiences openly. This transparency helps other users make informed decisions when choosing Freelancers or Event Organizers for their projects or events.

Accountability: Reviews hold users accountable for their actions and performance. Positive reviews acknowledge excellent service, while constructive feedback helps identify areas for improvement.

Improvement: Constructive feedback from reviews helps Freelancers and Event Organizers enhance their services, communication, and overall performance. By listening to feedback and making improvements, users can strive for excellence and build a positive reputation on the platform.

 

 

 

 

Importance of Reviews:

Trust Building: Positive reviews build trust and credibility, both for individual users and the platform as a whole. They demonstrate a track record of successful transactions and satisfied customers.

Decision Making: Reviews serve as valuable insights for other users when making decisions about whom to hire or work with. They provide firsthand accounts of past experiences, helping users assess the reliability and professionalism of potential partners.

 

Review Guidelines:

Honesty: Reviews should be honest and based on genuine experiences. Users are encouraged to provide constructive feedback while avoiding personal attacks or inappropriate language.

Fairness: Reviews should be fair and objective, reflecting the true nature of the transaction. Users should refrain from leaving biased or misleading reviews.

Respect: Users should respect each other’s opinions and feedback, even if they disagree. Differences in opinion are natural, but respectful communication is essential for maintaining a positive community environment.

 

6.   Cancellation and Dispute

Initial Cancellation Period: Upon placing an order, both freelancers and event organizers (referred to as Employers) are entitled to a brief initial cancellation period. During this time, which typically spans 24 to 48 hours after order placement, either party may cancel the order without incurring penalties.

Project Milestones: For projects with multiple deliverables or longer durations, cancellations may be subject to milestone-based policies. Each milestone may have its cancellation window, allowing flexibility while maintaining accountability. The specific cancellation terms for each milestone will be outlined in the project agreement.

Progress-Based Cancellation: Cancellation policies may be tied to the progress made on the project. Once a significant portion of the work is completed, cancellation may no longer be allowed, or cancellation fees may apply. The determination of the project’s completion percentage and associated cancellation terms will be at Festiivize’s discretion.

Mutual Agreement: Both parties may agree to cancel a project at any time. However, cancellation terms, including any associated fees or refunds, must be mutually consented to by both the freelancer and the event organizer.

Emergency Situations: Exceptions to the cancellation policy may be made in cases of emergencies or unforeseen circumstances that prevent either party from fulfilling their obligations. Such situations will be reviewed on a case-by-case basis by Festiivize’s dispute resolution team.

 

Dispute Resolution:

Attempted Resolution: Festiivize encourages both freelancers and event organizers to attempt to resolve any disputes or conflicts among themselves first. Open and transparent communication is vital in reaching an amicable resolution.

Escalation to Festiivize: If parties are unable to resolve a dispute independently, either party may escalate the issue to Festiivize for mediation and resolution. Festiivize will review the details of the dispute and work with both parties to find a fair and reasonable solution.

Fair Evaluation: Festiivize’s dispute resolution team will conduct a fair and impartial evaluation of the dispute, taking into account all relevant information provided by both parties. The decision reached by Festiivize will be final and binding.

Enforcement of Decisions: Both freelancers and event organizers are obligated to comply with any decisions or resolutions made by Festiivize’s dispute resolution team. Failure to do so may result in account sanctions or other penalties as outlined in Festiivize’s Terms of Use.

 

 

7.   User Conduct and Protection

Festiivize is committed to fostering a safe, inclusive, and respectful environment for all users. This section outlines the expected conduct of users on the platform and the measures in place to ensure their protection.

Users of Festiivize are expected to adhere to the following code of conduct:

Respect: Treat all users with courtesy, respect, and professionalism. Harassment, discrimination, hate speech, or any form of abusive behavior will not be tolerated.

Integrity: Act honestly, ethically, and transparently in all interactions. Avoid misrepresentation, fraud, or deceptive practices.

Compliance: Abide by all applicable laws, regulations, and Festiivize policies. Do not engage in any activities that violate legal or ethical standards.

Communication: Maintain open and constructive communication with other users. Respond promptly to messages, inquiries, and requests for information.

Confidentiality: Respect the privacy and confidentiality of other users’ information. Do not share sensitive or confidential data without proper authorization.

 

User Protections

Festiivize is committed to protecting the rights and interests of its users. The platform provides the following safeguards to ensure user protection:

 

Privacy: Safeguard user data and information in accordance with Festiivize’s privacy policy. Implement robust security measures to prevent unauthorized access or misuse of user data.

Security: Employ industry-standard security protocols to protect user accounts, transactions, and communications. Regularly monitor the platform for any security vulnerabilities or breaches.

Dispute Resolution: Offer a fair and impartial dispute resolution process to address conflicts or disputes between users. Facilitate open communication and mediation to achieve mutually acceptable resolutions.

Feedback Mechanism: Provide users with the ability to leave feedback and reviews for each other based on their interactions and experiences. Use feedback to identify and address any issues or concerns promptly.

Anti-Fraud Measures: Implement measures to detect and prevent fraudulent activities, such as identity theft, payment fraud, or fake reviews. Take swift action against any users found to be engaging in fraudulent behavior.

 

 

 

 

 Reporting Mechanism:

Users who encounter any violations of Festiivize’s code of conduct or suspect fraudulent or abusive behavior are encouraged to report such incidents promptly. Festiivize provides a reporting mechanism through which users can submit complaints, concerns, or requests for assistance. Reports will be reviewed and investigated by Festiivize’s support team, who will take appropriate action in accordance with Festiivize’s policies and procedures.

 

User Responsibilities:

While Festiivize endeavors to provide a safe and secure platform, users also have a responsibility to exercise caution and diligence in their interactions and transactions. Users should:

 

Verify Information: Verify the identity, credentials, and qualifications of other users before entering into any agreements or transactions.

Use Caution: Exercise caution when sharing personal or financial information with other users. Avoid disclosing sensitive data unless necessary and ensure that communications are conducted through secure channels.

Report Concerns: Report any suspicious or inappropriate behavior to Festiivize’s support team promptly. Do not hesitate to seek assistance or guidance if encountering any issues or concerns.

 

Violation Policy:

Festiivize is committed to maintaining a safe, secure, and respectful environment for all users. Violations of Festiivize’s policies, code of conduct, or terms of service may result in disciplinary action, up to and including account suspension or termination. The following actions are considered violations of Festiivize’s policies:

 

 

Harassment: Engaging in harassment, bullying, or intimidation of other users, including but not limited to verbal abuse, threats, or derogatory remarks based on race, ethnicity, gender, religion, sexual orientation, disability, or any other characteristic.

Fraudulent Activity: Participating in fraudulent or deceptive activities, such as identity theft, payment fraud, fake reviews, or any form of dishonesty or misrepresentation.

Illegal Conduct: Engaging in any illegal or unlawful activities, including but not limited to copyright infringement, unauthorized use of intellectual property, or violation of applicable laws and regulations.

Abusive Behavior: Using Festiivize’s platform to engage in abusive, harmful, or malicious behavior, such as spamming, phishing, hacking, or distributing malware.

Violation of Privacy: Violating the privacy rights of other users, including unauthorized access to personal or confidential information, sharing sensitive data without consent, or any other breach of privacy.

 

Reporting Violations

Users who encounter violations of Festiivize’s policies or witness any inappropriate or abusive behavior are encouraged to report such incidents promptly. Festiivize provides a reporting mechanism through which users can submit complaints, concerns, or requests for assistance. The reporting process is designed to be accessible, confidential, and responsive to user needs. Here’s how to report violations on Festiivize:

 

Reporting Process: Users can report violations by contacting Festiivize’s support team through the designated reporting channels. This may include submitting a report through the platform’s messaging system, emailing Festiivize’s support team directly, or using the online reporting form provided on the Festiivize website.

Information Required: When reporting a violation, users should provide as much detail as possible about the incident, including the nature of the violation, the identity of the individuals involved (if known), and any supporting evidence or documentation. Providing accurate and comprehensive information will help expedite the investigation process and facilitate appropriate action.

Confidentiality: Festiivize treats all reports of violations with the utmost confidentiality and discretion. Users can rest assured that their privacy and anonymity will be respected throughout the reporting process. However, in certain cases, Festiivize may need to disclose information to relevant parties for the purpose of investigation or resolution.

Response Time: Festiivize is committed to promptly addressing reports of violations and taking appropriate action to remedy the situation. Upon receiving a report, Festiivize’s support team will initiate an investigation to assess the validity of the complaint and determine the appropriate course of action. Users who submit reports will be kept informed of the status and outcome of their report to the extent possible.

 

8.   Confidentiality and Ownership

Confidentiality:Protection of Confidential Information: Festiivize respects the confidentiality of all information shared between freelancers and event organizers (referred to as Employers) on the platform. Any information disclosed during the course of a project, including but not limited to business strategies, trade secrets, proprietary data, and personal information, shall be treated as confidential.

Non-Disclosure Agreement (NDA): By using Festiivize, freelancers and Employers implicitly agree to maintain the confidentiality of any sensitive information exchanged during the project duration. Festiivize may provide a standard non-disclosure agreement template for parties to formalize their commitment to confidentiality, if deemed necessary.

Employer Disclosures: Employers may need to disclose certain confidential information to freelancers for the purpose of completing the ordered work. This may include proprietary data, client information, or project specifications. Freelancers are obligated to handle such information with the utmost care and refrain from using it for any purpose other than fulfilling the project requirements.

Protection Measures: Festiivize implements robust security measures to safeguard all user data and confidential information stored on the platform. This includes encryption, access controls, and regular security audits to mitigate the risk of unauthorized access or data breaches.

 

 Ownership

Intellectual Property Rights: Unless otherwise specified in the project agreement, all intellectual property rights associated with the work delivered through Festiivize shall belong to the respective creator (freelancer). This includes but is not limited to copyrights, trademarks, patents, and any other proprietary rights.

Transfer of Ownership: Upon successful completion of a project and full payment by the Employer, the freelancer hereby transfers all ownership rights of the deliverables to the Employer. Festiivize facilitates the transfer of ownership and ensures that the Employer receives the necessary licenses or rights to use the work as intended.

License Agreement: Freelancers may retain certain rights to use the work for portfolio or promotional purposes, subject to the Employer’s consent. Employers may specify any additional terms regarding the usage rights of the deliverables in the project agreement.

Third-Party Content: In cases where freelancers incorporate third-party content (such as stock images, fonts, or software) into their deliverables, they are responsible for ensuring compliance with the respective license agreements. Freelancers must disclose any third-party content used and obtain appropriate licenses or permissions as necessary.

 

9.   Disclaimer of Warranties 

As-Is Basis: Festiivize provides its platform and services on an “as-is” and “as available” basis. We make no representations or warranties of any kind, express or implied, regarding the reliability, accuracy, completeness, or suitability of the platform or the information, products, services, or related graphics contained on the platform for any purpose.

No Guarantees: We do not warrant that the platform will be uninterrupted, timely, secure, or error-free, nor do we make any warranty as to the results that may be obtained from the use of the platform, or the accuracy or reliability of any information obtained through the platform.

Use at Own Risk: Any reliance you place on the platform, its content, or services provided is strictly at your own risk. You acknowledge and agree that any use of the platform, its content, or services is subject to your own discretion and judgment, and you will be solely responsible for any consequences arising from such use.

No Endorsement: Festiivize does not endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the platform or any hyperlinked website or featured in any user submission or other advertising, and we will not be a party to or in any way monitor any transaction between you and third-party providers of products or services.

No Warranty of Accuracy: While we strive to ensure the accuracy of information provided on the platform, we make no warranties or representations as to the accuracy, completeness, or reliability of any information, content, materials, or services provided on or through the platform.

Limitation of Liability: In no event shall Festiivize, its affiliates, officers, directors, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses) arising out of or in connection with your use of the platform, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been informed of the possibility of such damage.

Indemnification: You agree to indemnify and hold Festiivize and its affiliates, officers, directors, employees, agents, and licensors harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or in connection with your use of the platform, your violation of these terms of service, or your violation of any rights of any third party.

Modifications: Festiivize reserves the right, at our sole discretion, to modify or replace any part of these terms of service at any time without prior notice. It is your responsibility to check these terms of service periodically for changes. Your continued use of the platform following the posting of any changes to these terms of service constitutes acceptance of those changes.

 

10. Limitation of Liability

Exclusion of Certain Damages: In no event shall Festiivize, its affiliates, officers, directors, employees, agents, or licensors be liable to you or any third party for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the Festiivize platform, regardless of whether such damages were foreseeable or whether Festiivize was advised of the possibility of such damages.

Total Liability: In no event shall the total liability of Festiivize, its affiliates, officers, directors, employees, agents, or licensors to you for all damages, losses, and causes of action arising out of or relating to these terms of service or your use of the Festiivize platform, whether in contract, tort (including negligence), warranty, or otherwise, exceed the amount paid by you, if any, to Festiivize for accessing and using the platform during the twelve (12) months immediately preceding the event giving rise to the claim.

Basis of the Bargain: You acknowledge and agree that Festiivize has offered its platform and services, set its prices, and entered into these terms of service in reliance upon the warranty disclaimers and the limitations of liability set forth herein, that the warranty disclaimers and the limitations of liability set forth herein reflect a reasonable and fair allocation of risk between you and Festiivize, and that the warranty disclaimers and the limitations of liability set forth herein form an essential basis of the bargain between you and Festiivize.

Essence of Remedies: You acknowledge and agree that if you are dissatisfied with the Festiivize platform or any aspect thereof, or with these terms of service, your sole and exclusive remedy shall be to discontinue use of the Festiivize platform. You further acknowledge and agree that any remedy provided by Festiivize under these terms of service is in lieu of any other remedy available to you at law or in equity.

Basis of Allocation: Each provision of these terms of service that provides for a limitation of liability, disclaimer of warranties, or exclusion of damages is to allocate the risks under these terms of service between the parties. This allocation is reflected in the pricing offered by Festiivize to you and is an essential element of the basis of the bargain between the parties. Each of these provisions is severable and independent of all other provisions of these terms of service. The limitations in this section will apply even if any limited remedy fails of its essential purpose.

 

11. Privacy Policy

Data Collection: Festiivize collects personal information from users during registration, order processing, and communication on the platform. This includes but is not limited to names, contact details, payment information, and user preferences.

Data Usage: The information collected by Festiivize is used to provide and improve the platform’s services, personalize user experience, process transactions, and communicate with users. User data may also be used for marketing purposes with user consent.

Data Protection: Festiivize implements industry-standard security measures to protect user data from unauthorized access, disclosure, alteration, or destruction. This includes encryption, firewalls, and access controls to safeguard sensitive information.

 

Third-Party Sharing: Festiivize may share user data with trusted third-party service providers for purposes such as payment processing, analytics, and marketing. These third parties are bound by confidentiality agreements and are prohibited from using user data for any other purpose.

Cookies and Tracking: Festiivize uses cookies and similar tracking technologies to enhance user experience, analyze usage patterns, and personalize content. Users may adjust their browser settings to refuse cookies, but this may limit certain features of the platform.

User Control: Users have the right to access, update, or delete their personal information stored on Festiivize’s platform. Users can also opt out of marketing communications and adjust their cookie preferences.

Changes to Privacy Policy: Festiivize reserves the right to update its Privacy Policy periodically to reflect changes in legal requirements, business practices, or user feedback. Users will be notified of any significant changes to the Privacy Policy.

 

12. Community Guidelines

Respectful Conduct: Users are expected to engage with each other in a respectful, courteous, and professional manner at all times. Harassment, discrimination, hate speech, or any form of abusive behavior will not be tolerated.

Prohibited Content: Users must refrain from posting or sharing content that is illegal, offensive, defamatory, or infringes on the rights of others. This includes but is not limited to hate speech, pornography, spam, or malware.

Intellectual Property: Users should respect the intellectual property rights of others and refrain from using copyrighted materials without proper authorization. Any content shared on Festiivize should either be original or properly licensed.

Transparency and Honesty: Users should provide accurate and truthful information when creating profiles, listings, or communications on the platform. Misrepresentation, fraud, or deceptive practices are strictly prohibited.
